Definitions

Client - a natural person or legal person concluding a contract with the Organizer for participation in the Course.

Consumer - a natural person, concluding a contract with the Organizer for participation in the Course, not directly related to the business activity carried out by him.

Course - online event of an educational nature created by the Organizer.

Account - individual Client account within which Course materials are made available.

Organiser - Stanisław Świątkiewicz, running a sole proprietorship under the company DOKO Stanisław Świątkiewicz with its registered office in Wrocław, (53-148 Wrocław), Wolbromska 18/1B, NIP 899-284-20-76.

Portalo - educational panel at https://nueve.podia.com/ where the Client has access to the Account, as well as the website of the selected course, on which the Client will find all the necessary information. These Terms and Conditions apply to the parties:

§ 1. General provisions Within the Portal, the Organizer allows you to Register and access the Course according to the package you have chosen. To use the Portal it is not necessary to meet special technical requirements, and it is sufficient:

internet access
using a standard web browser
having an active email address.

As part of the Portal, we provide electronic services in the form of:

registration for the course,
access to educational materials offered as part of the purchased package,
participate in online events offered as part of the Course program.

When using the Portal and taking part in the Course, please remember to:

not to publish content of an illegal nature, contrary to the law or good customs,
not to provide materials that could negatively affect the operation of the Portal, disrupt or burden its operation,
not to publish content that could violate the rights of others,
not post content that contains malware, including viruses or spyware;
not to publish content that could cause SPAM to be sent to other users of the Portal.

As part of the Portal, we provide electronic services in the form of:

registration for the course,
access to educational materials offered as part of the purchased package,
participate in online events offered as part of the Course program.

We strive to make the Portal available 24/7. We will inform you of any planned interruptions in access by email. As part of the Portal, we use organizational and technical measures to ensure the security of your data and published content.

§ 2. Placing an order The conclusion of the contract for participation in the course requires registration in the application form, to which you will be redirected after choosing a package. In the form it is necessary to provide the necessary personal data, and the condition for placing an order is acceptance of the Regulations. Once registration is complete, you will be redirected to the payment gateway, where you will be able to choose a payment method. After completing the payment, you will be redirected to the Portal page, where we confirm the placing and payment of the order by you - from this moment an agreement for the provision of services by electronic means is concluded. Confirmation of the conclusion of the contract and instructions for using the Account and access to the Course will also be sent to the e-mail address provided during Registration. As part of the Registration, you are obliged to provide your real personal data. If you provide false information or we have reasonable doubt as to whether it is true, we reserve the right to suspend the processing of the order and contact you to clarify the situation.

§ 3. Access to the Course With the confirmation of the conclusion of the contract for the provision of services by electronic means, you will receive access to the Course with instructions on how to use it. Access to the Course will be possible through the dedicated platform, available at the address indicated, where after purchasing the package your individual Account will be created.
According to your chosen package, every day of the Course you will receive an email informing you of the availability of recordings and materials that you will be able to use together with information about the program elements delivered “live”. Course recordings and materials will be available in your Account for life from the date they are posted. Remember to use the Portal and participate in the Course in accordance with the provisions of the Terms and Conditions. If you violate the rules set out herein, we reserve the right to prevent you from continuing to participate in the Course and use the Portal.

§ 4. Delivery and payment The prices of the packages for participation in the Course are gross prices.

You can pay for your participation in the Course using electronic payments offered by Stripe Inc. as part of the Stripe service. By choosing to receive a VAT invoice for the purchase of the package, you agree to receive it in electronic form, to the email address you provided during Registration. After payment is made to the email address you provided during Registration, you will receive access to your Account along with instructions on how to access the Course.
In addition, the user has the opportunity to subscribe to the Nueve+ subscription in the selected price package, with a monthly fee. The subscription cancellation period is 30 days.

§ 5. Withdrawal from the contract
In accordance with the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended) A consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving reasons and incurring costs, with the exception of the costs of processing the transaction. The provision does not apply to the Nueve+ subscription.

An extended return period within 30 days of purchase applies to certain courses. If you want to return the course after 14 days, please inform us by sending an email to kontakt@model9k.com, before the deadline. You will not be entitled to withdraw from the contract if:

a) we have fully performed the service you purchased,
b) you have consented to the delivery of the purchased content to you immediately after purchase. If you withdraw from the contract, we will have to deactivate your access to the Course. We will refund the purchase costs to you no later than 14 days after you withdraw from the contract in the same way you made the payment.

§ 6. Satisfaction Guarantee If the substantive value of the Course was not in accordance with the program and the information you received, i.e. the lectures did not cover the announced topic, you can ask the Organizer for a refund of the price. The refund time is specified on the website of the specific course: model9k.com

A condition for the return is to describe the reasons for dissatisfaction with the quality of the materials. We will reimburse you no later than 14 days after you withdraw from the contract in the same way as you made the payment.

§ 7. Consideration of complaints and enforcement of claims If you consider that the services we provide as part of the Course are incompatible with the offer, the Course program or the provisions of the Regulations, you can file a complaint by sending an email to kontakt@model9k.com.

In the complaint, include your data and describe what the non-compliance consisted of. We will consider the complaint within 21 days of receiving it by sending you a response to the email address from which you contacted us. If you do not receive a response from us within 21 days, it means that we have taken your complaint into account. In accordance with the provisions of the law, if you have made a purchase as a Consumer, in the event of a dispute between us regarding the services we provide, you can use out-of-court means of dealing with complaints and pursuing claims in the form of: filing a complaint through the ODR online platform for resolving disputes between consumers and ODR entrepreneurs, available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=PL, or

Submission of an application for settlement of the dispute to the permanent amicable consumer court, or to submit an application for out-of-court resolution of the dispute to the provincial inspector of the Trade Inspection.

§ 8. Personal data and cookies The rules for the processing and protection of your data and the use of cookies are set out in the Privacy Policy, available at: https://www.model9k.com/licencing

§ 9. Rights to content The educational materials you receive while taking the Course, all text, graphics and digital content are our property and we are copyrighted to them. We aim to share with you the knowledge contained in these materials, but we do not agree that you download, copy and distribute them in an illegal manner. If you need to use any material or part of it, please contact us by sending an email to kontakt@model9k.com.

§ 10. Final provisions As an Organizer, we may make changes to the rules set out in the Terms and Conditions, provided that such change:

will comply with the law
does not infringe any rights you have already acquired (in particular those related to the purchase of participation in the Course)
will result from our obligation to adapt the Rules to changes in the law or decisions of courts or authorities will result from the need to protect you or us as the Organizer from violating the rules described in the Regulations.

We will inform you about any changes to the Terms and Conditions by sending an email to the address you have provided.
